We draft and serve a legal notice requiring possession upon your tenant with a strong covering letter requesting that they leave your property. We find that tenants leave about 80% of the time with just the notice. We normally serve either a Section 8 and/or Section 21 notice which are both under the Housing Act 1988. In some circumstances we send further letters to your tenant requesting them to leave and contact them by telephone.
Stage 2 Court Proceedings
If the tenant ignores the notice and does not leave the property, we send instructions to our solicitors to issue legal proceedings. In some cases such as non payment of rent, it is necessary that you attend court to give evidence however, you will have legal representation attending with you. Under the Section 21 procedure the Court will make an Order for Possession without a hearing.
Stage 3 Bailiff
If your tenant still does not leave we will instruct the Bailiffs to attend the property and physically evict your tenant.
